Onsite Wastewater Management Program

The area where sewers will be installed consists of only about 1/3rd of the total area in town.  Most of town, however, still has very poor soil for installing On-Site Wastewater Treatment Systems (OWTS) more commonly known as septic systems. 

Modern OWTS work very well even in poor soil conditions, however, it is important to monitor and maintain an OWTS to insure that the ground water does not become contaminated.  An On-site Wastewater Management Program was adopted in July 2006 to insure that our precious water resources do not become contaminated from failing OWTS.  I have included a link to two documents for those readers who want to learn more about the program as it is proposed.  The On-site Wastewater Management Plan which was approved by DEM last year and the On-site Wastewater Management Ordinance which was adopted by the Town Council in July 2006.

NANAQUAKET POND WATERSHED

The first letters requiring property owners within the Nanaquaket Pond Watershed to have their septic systems inspected by an Approved Septic System Inspector went out last fall. Those properties that got a letter should have had your inspection by now. In order to get though all the inspections in the time we are allowed by the ordinance, we need everyone’s cooperation. If you have not had your inspection yet, please make every effort to have it performed as soon as possible. The second batch of letters is being prepared now and will be going out this spring.

STAFFORD POND WATERSHED

By now, all inspections should have been completed in this Watershed. They haven’t. Some residents have ignored our letters and have not yet had their septic systems inspected. Those properties have received Notices of Noncompliance by registered mail. Failure to comply with this notice will result in punitive action including fines.

*****ABOUT THE INSPECTIONS*****

Each of our inspectors has completed the RI Septic System Inspector’s course and passed the certification exam. This means that no matter which inspector you use, they are all doing the same inspection. They have also submitted proof of insurance. Many of these wastewater professionals are installers and designers, so rest assured they know septic systems.

The inspection that we are requiring will gather baseline information about your septic system and set an initial routine inspection/pump-out schedule for the property. The inspector must file his report directly into the Town’s on line reporting and tracking software. Please click on the link below to see a list of approved septic system inspectors.

In accordance with the On-Site Ordinance, all properties within the Town that rely on a septic system for their on site treatment or disposal of wastewater must have their septic system inspected and placed on a mandatory maintenance schedule. The mandatory inspection and maintenance schedule has been phased in with the following schedule:

· July 2007 Stafford Pond Watershed (cesspool replacement mandatory)

· July 2008 Nanaquacket Pond Watershed

· July 2010 Nonquit Pond Watershed

· July 2012 Sakonnet Waterfront

· July 2014 Remainder of Town

*****ALL PROPERTIES WITH CESSPOOLS*****

Cesspools are a sub-standard method of treating your wastewater. Our goal is to eventually phase out all cesspools. Per zoning ordinance, all cesspools within the Stafford Pond Watershed should have been upgraded by the end of December 2005. Homeowners, who live within 200 feet of a critical resource such as the shoreline or a public drinking water supply, will be required by state law to have their cesspools upgraded by January 1, 2013. All other properties should have their cesspool pumped on an annual basis and have it inspected at least every other year. There are three triggers that will require a resident to upgrade a cesspool.

The 1st trigger is a phased approach, requiring septic systems in the most sensitive critical resource areas to be inspected first (see the schedule below). If the inspection reveals that the cesspool has failed, the homeowner will have one year to replace the cesspool. If the cesspool is found to be functioning, it will be put on an annual schedule of inspection and pumpout. Conventional septic systems will be put on an inspection and pumpout schedule based on the individual usage. Inspection and pumpout schedules may range from as much as annual to as little as once every 5 years.

The 2nd trigger is the new state law that requires all properties with cesspools that are within 200 feet of a critical resource to upgrade their cesspool by January 1, 2013. A critical resource is either the Shoreline or a public drinking water supply or wellhead.

The 3rd trigger is the sale of a property. If a property that is serviced by a cesspool is sold, the new owner will have 12 months to upgrade the cesspool to a system that conforms to RIDEM Regulations. Properties that were already listed with a real estate agent or were under a purchase and sales agreement between a buyer and seller as of January 1, 2007 may be exempt from this requirement. Please call the Wastewater Superintendent to see if your property is exempt.
